NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. BY PLAYING, EACH PARTICIPANT AGREES TO THESE OFFICIAL RULES.

  1. Eligibility:  The OLIPOP Instant WinGame Summer Promotion, Instant Win Game (the “Game”) is open to legal residents of the 50 United States, and District of Columbia who are 18 years of age or older (or 19 years of age or older if a resident of AL or NE) (an “Entrant”). Void where prohibited. No purchase necessary to participate in the Game. Employees of OLIPOP, Inc., (the “Sponsor”), Brandmovers, Inc. (“Administrator”), and/or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Game (collectively with Sponsor, the "Game Entities") and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to enter or win. The Game is subject to all applicable federal, state, and local laws and regulations. Participation constitutes a participant’s full and unconditional agreement to these Official Rules and Sponsor's and Administrator’s decisions, which are final and binding in all matters related to the Game. Winning a prize is contingent upon fulfilling all requirements set forth herein.

  2. Game Period:  The Game begins at 12:00:00 AM Eastern Time (“ET”) on July 15, 2026, and ends at 11:59:59 PM ET and ends on August 30, 2026 (the "Game Period").
  3. How to Play the Game –   During the Game Period, randomly pre-selected times will be assigned to the Instant Win Prizes available to be awarded in the Game, and the first entrant who completes a Play as described below, and whose Play is properly received and recorded by Sponsor's computer at or after a randomly pre-selected winning time will win an Instant Win Prize, subject to verification. There are two (2) ways to play the Game:

    a) Qualifying Purchase:  To play the Game via this method, purchase any OLIPOP during the Game Period (a “Qualifying Purchase”), and visit http://olipoponthemenu.com/ (the “Website”) to complete and submit an official entry form and upload a copy of your receipt showing your Qualifying Purchase (which must have been made during the Game Period). Upon Administrator/Sponsor’s receipt of the entry form and photo upload, an email verification will be automatically sent to the entrant, who then must verify the email prior to, and as a condition of, proceeding to play the Game. Once the email is verified by the Entrant, the Entrant can follow the on-screen instructions on the Website instructing them how to play the Game by scratching the virtual card to see if they are a winner of an Instant Win Prize (each, a “Play”). If, the message on the screen immediately following a Play reveals a “WINNING MESSAGE” message, that Entrant is a potential Instant Win Prize winner, subject to verification per the instructions below. If the message on the screen immediately following a Play reveals a “NON-WINNING MESSAGE” message, that Entrant is not an Instant Win Prize winner. There is no limit to the number of Plays an Entrant may receive during the Promotion Period; however, each Play must be supported by a unique, valid receipt reflecting a separate Qualifying Purchase. Each receipt may be used only once. Receipts that have previously been submitted are void and may not be reused to obtain additional Plays.

    If an Entrant receives an Instant Win Prize winning message as indicated in the paragraph above, they will automatically receive an email notification from Sponsor or Administrator requesting a reply within 72 hours from the time the email notification is sent to confirm eligibility and the mailing address where the Prize will be shipped. Upon Sponsor’s or Administrator’s receipt of the initial email reply within the 72-hour timeframe, Sponsor or Administrator may, at its sole discretion, either (1) mail the Instant Win Prize to the winner, or (2) may send a follow up email including an affidavit of eligibility, liability and publicity release (where legal), (collectively, “Prize Release Documents”) to the potential Instant Win Prize winner, wherein the potential Instant Win Prize winner must then complete, sign and return the Prize Release Documents within 5 business days of Sponsor or Administrator sending the Prize Release Documents, in order to be deemed an official Instant Win Prize winner. Upon receipt of the completed Prize Release Documents within the 5-business day timeframe, Sponsor will mail the Instant Win Prize winner. In the event a potential winner fails to meet any of the deadlines set forth above, that potential Instant Win Prize winner forfeits their right to be deemed an official Instant Win Prize winner and win the Instant Win Prize. Neither Sponsor nor Administrator are responsible for emails that go into the SPAM or Junk folder, are unanswered within the timeframes set forth above, are undeliverable, or for any technical glitches interfering with the email messages being sent or received.

    For purposes of this Game, “receipt” of an entry and photo upload of a receipt occurs when Sponsor/Administrator’s server records the entry information resulting from the Entrant submitting the entry and uploading the photo. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service) are not permitted and will be disqualified.

    b) Free Mail-In Entry – Or, to play the Game without making a Qualifying Products purchase, hand print your complete name, address, email address (required) and telephone number (optional) on a 3 x 5” paper and mail in a first-class stamped envelope to: OLIPOP OLIPOP Instant WinGame Summer Promotion, c/o Brandmovers, Inc., P.O. Box 1807 Clayton, GA 30525, to be postmarked by August 30, 2026 and received by September 6, 2026. Upon Administrator’s receipt of the Mail-In Entry, Administrator will submit a Play in the Game on behalf of the Entrant to see if the Entrant is a potential winner of an Instant Win Prize. ONLY WINNER’S WILL BE NOTIFIED OR ACKNOWLEDGED. If the Entrant is a potential Instant Win Prize winner, the Administrator will email the potential winner requesting a reply within 72 hours from the time the email notification is sent to confirm eligibility and the mailing address where the Prize will be shipped. Upon Sponsor’s or Administrator’s receipt of the initial email reply within the 72-hour timeframe, Sponsor or Administrator may, at its sole discretion, either (1) mail the Instant Win Prize to the winner, or (2) may send a follow up email including an affidavit of eligibility, liability and publicity release (where legal), (collectively, “Prize Release Documents”) to the potential Instant Win Prize winner, wherein the potential Instant Win Prize winner must then complete, sign and return the Prize Release Documents within 5 business days of Sponsor or Administrator sending the Prize Release Documents, in order to be deemed an official Instant Win Prize winner. Upon receipt of the completed Prize Release Documents within the 5-business day timeframe, Sponsor will mail the Instant Win Prize winner. In the event a potential winner fails to meet any of the deadlines set forth above, that potential Instant Win Prize winner forfeits their right to be deemed an official Instant Win Prize winner and win the Instant Win Prize. Neither Sponsor nor Administrator are responsible for emails that go into the SPAM or Junk folder, are unanswered within the timeframes set forth above, are undeliverable, or for any technical glitches interfering with the email messages being sent or received. Limit one (1) mail-in entry per person per outer envelope and per postage stamp date.

    Game Odds: Odds of winning an Instant Win Prize strictly depend on the number of eligible Plays received and the timing of such Plays relative to the randomly pre-selected times will be assigned to the Instant Win Prizes available.
  4. Instant Win Prizes and Approximate Retail Values (“ARVs”): 200 Instant Win Prizes–  100 (one hundred) Polyester Bucket Hats $22.20 per hat x 100 $2,220.00, and 100 (one hundred) Prime Line Mini Recycled Tote Bag, $8.85 per bag X 100 $885.00 Total ARV of all Instant Win Prizes to be awarded is $3,105.00.

    Prizes are not transferable and may not be redeemed for cash value. All federal, state and local taxes on prizes are the sole responsibility of the winner. No substitutions of prize, except Sponsor may substitute a prize, or portion thereof, for one of equal or greater value at Sponsor’s sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor’s sole discretion. Any unclaimed Prizes remain property of Sponsor and will go unawarded.
  5. Entry Conditions and Release:  By entering, each entrant agrees to release, indemnify, defend and hold harmless the Game Entities from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Game, acceptance or use or misuse of prize (including any travel or activity-related thereto) and/or the broadcast, exploitation or use of entry.
  6. General Conditions:  All entries become the property of the Sponsor. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who submits more than the one permitted entry, or who the Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, or proper play of this Game. Sponsor reserves the right to cancel, suspend and/or modify the Game, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Game, as determined by Sponsor in its sole discretion. If the Game is terminated before the designated end date, Sponsor will (if possible) award the Grand Prizes and any unclaimed Instant Win Game prize in a random drawing from all eligible, non-suspect entries registrations received as of the date of the event giving rise to the termination or as otherwise deemed fair and appropriate by Sponsor. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Entrant further agrees and acknowledges that Sponsor reserves the right to forfeit or award any unclaimed or leftover Prize at its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Game or to be acting in violation of these Official Rules or any other Game or in an unsportsmanlike or disruptive manner and void all associated entries, game plays, and/or prizes claims. Any attempt by any person to deliberately undermine the legitimate operation of the Game may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

    Sponsor reserves the right, in its sole discretion, to verify the authenticity and eligibility of all receipts and entries. Any attempt to submit the same receipt more than once, alter or fabricate receipts, use fraudulent receipts, or otherwise circumvent these Official Rules constitutes fraud and may result in disqualification from this Promotion. Any entrant found to have engaged in fraudulent activity or abuse of the Promotion will be deemed ineligible, may forfeit any prizes, and may be prohibited from participating in this and any future promotions offered by Sponsor, to the fullest extent permitted by law.
  7. Limitations of Liability:  The Game Entities as set forth above are not responsible for: (1) for late, lost, jumbled, garbled, misdirected, delayed, incomplete, incorrect, or inaccurate entries, game plays, prize claims, email, mail, or other communications of any kind, whether caused by any of the equipment or programming associated with or utilized in this Game or by any human error; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Game; (3) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (4) unauthorized human intervention in any part of the entry process or the Game; (5) technical, network, mechanical, typographical, human or other error or problem which may occur in connection with the Game, including, but not limited to, errors or problems which may occur in the administration of the Game or the processing of entries, game plays or prize claims, the announcement of the prizes, or in any Game-related materials; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Game or receipt or use or misuse of any prize (including any travel or activity-related thereto). If for any reason an entry I or game play s confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry or game play in the Game, provided that the Game has not been terminated.
  8. Disputes/Governing Law:  Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Game, other than those concerning the administration of the Game or the determination of Winners or for any disputes arising from the loss or injury from the participation in a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules (except for any disputes arising from the loss or injury from the use of Prizes) shall be submitted to final, binding arbitration conducted in the State of California under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired California state or federal court judge with experience in entertainment matters who shall follow California law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in the state of California, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of the state of California. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in the state of California; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Game, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Game shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
  9. Data Collection:  Information collected from entrants in connection with the Game shall be used in accordance with Sponsor’s privacy policy, available at http://olipoponthemenu.com/.
